1. Acceptance of Terms
By accessing or using Eloquence, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.
2. Description of Service
Eloquence is an AI-powered writing and content production studio. We reserve the right to modify or discontinue the service at any time during our beta testing phase.
3. User Content
You retain all rights to the initial content you provide. You grant Eloquence a license to use, reproduce, and process your content solely for the purpose of providing the service.
4. AI Generated Content
The service uses artificial intelligence. You are solely responsible for reviewing and verifying the accuracy of any generated content before publication.
5. Prices, credits and payment
Plans and credit packs are sold in euro at the prices shown on the pricing page, which include VAT where it applies. Plan credits are added at the start of each billing period and are not carried over as a cash balance; credit pack (Boost) credits do not expire while your account is open. Capturing notes, editing your own drafts and reading your work never consume credits — only AI operations do, at the rates published in the app before you run them.
Accounts created on or before 30 September 2026 (Luxembourg time) are founding accounts. A founding account receives 200 credits at the start of each calendar month, at no charge, for as long as the account remains open. These credits are added to your balance like any other, are not a cash balance, and are not redeemable for money. They are granted in addition to any plan you subscribe to, and they end only if the account is closed or disabled.
6. Right of withdrawal and refunds
Under the EU Consumer Rights Directive (2011/83/EU), as implemented in Luxembourg, a consumer buying at a distance normally has 14 days to withdraw from the purchase without giving a reason. For digital content and services that are supplied immediately, that right is lost once you have given your express consent to immediate supply and acknowledged losing it — which is what happens with credits, because they become usable the moment they are added to your balance. We could therefore treat credit purchases as final. We choose not to.
Our policy is deliberately more generous than the law requires. For 14 days after you buy a credit pack, you may hand it back from the plan page and be refunded in full, provided the credits are still unspent. Because credits are interchangeable, "unspent" means your credit balance is still at least as large as the pack you are returning. The refund removes those credits from your balance immediately and returns the money to the payment method you used; it cannot be undone, and buying the pack again later is a new purchase at the price of that day. If part of the pack has already been spent, the refund is declined rather than leaving your balance short — write to us and we will look at your case individually.
Subscriptions can be cancelled at any time in the billing portal. Cancelling stops future renewals; the period you have already paid for runs to its end and the credits granted for it stay yours. Refunds we issue at our discretion outside this policy, and refunds issued for a subscription period, may result in the corresponding credits being removed from your balance. Nothing in this section limits your statutory rights where they apply.
